Sasine to Issobell Neisbit
JAMES Neibit of LADYTOUNE, acted as attorney for ISSOBELL Neibit, eldest daughter of JAMES Neisbit elder of GREINHOLME and presented a contract of marriage between her and JOHN HAMILTONE of KYPE dated 7 March instant which contained a precept of sasine at the end in which JOHN HAMILTONE agreed to infeft ISSOBELL Neisbit , his future spouse in liferent and conjunct fee of all and whole his lands of SANCTBRYDCHAPPEL, presently tenanted y James Wilsone, lying in the barony of Lesmahagow and Sheriffdom of Lanark. The precept was written by James Young, writer in Strathaven and witnessed by JAMES Neisbit elder of GREINHOLME, JAMES Neisbit of LADYTOUNE, Gavin Hamiltone in Bank and the said James Young

Giving of sasine was witnessed by James Miller in Kype, Andrew Wilsone son to James Wilsone there, John Watsone, servitor to William Banatyne in Graingemuir and John Adam indweller in Tweedisyd

On the 23 February 1669, John Hutchesone, son of Hew Hutchesone, notary in Galston, acting as attorney for James Nesbit of Greenholme, presented a contract of wadset which had been granted to James Nesbit by his brother, Robert Nesbit, second son of the deceased James Nesbit elder of Greenholme, made at Newmylnes on the 22 August 1661. James Nisbit had engaged himself, on behalf of his brother, to pay certain sums for him and Robert had disponed to him, under reversion his five merklands of Litle Cesnok, his ten shilling lands of Hudstanes (Hirdstanes?) and his ten shilling lands of Whorlefoord, lying in the parish of Riccarton. The yearly annualrent on the principal sum was to be uplifted out of the rent and duty of the lands. Robert had also obliged himself to infeft James in the properties and had appointed James Loudoun in Newmylnes as his baillie in his precept of sasine. It had been written by Charles Hall, notary in Newmylnes and witnessed by Robert Nesbit in Loudounkirk, William Thomsone, tailor in Newmylnes, Hew Torrance, merchant there, the said Charles Hall and Gavin Lawsoun there.
Giving of sasine was witnessed by John Reid in Newmylnes, James Patersoun in Halfholmes, John Allan there and John Wight in Blackisbush?

James of Greenholm lent money to Hugh Dunbar and got wadset 40s Pencloe

On the 8 October 1668, James Neisbitt of Greinholme presented a contract of wadset which had been granted to him by Hew Dunbar of Knockshinoch, heritable proprietor of the lands underwritten, made at Galston on the 20 May last. James Neisbitt had lent him 4,000 merks Scots and Hew Dunbar had granted him his forty shilling lands of Pencloe, lying in the parish of Cumnock, under reversion. The annualrent on the principal sum was to be paid to James Neisbitt out of the rents and duties of the lands. Hew Dunbar also promised to infeft James Neisbitt. His precept of sasine had been included in the contract in which he had appointed William Campbell of Glaisnok, as his baillie. It was written by Hew Hutchesone, notary in Galston and witnessed by him and Johne Lockhart younger of Rae.
Witnesses to the giving of sasine were William Campbell of Shaw, Hew Dunbar servitor to George Campbell of Lochbrowan, Thomas Kenedie, servitor to William Crichtoun in Cumnok and James Conzie, servitor to Charles Logan in Litlemaynes of Cumnok

All of which heritably belonged to deceased JAMES Nisbet and he had borrowed money from the Hamiltons of Machlinholl. On the 2 October 1671, ANNA HAMILTON, daughter of JOHN HAMILTON of MACHLINHOLL, who was the nephew and heir of the deceased CLAUD HAMILTON of MACHLINHOLL, together with her husband, ROBERT AICHESONE OF SYDESERFF had brought two action in the Court of Session to apprise the lands of GREENHOLME for 5,520 merks which was owed by JAMES Nisbet. (An apprising allowed a debtor to annexe lands to the amount of a debt owed. The debtor had 10 years to repay the debt, otherwise the creditors could retain the property) These were dated 4 October 1670 and 2 October 1671.
Apprisings could be sold on and this is what ANNA HAMILTON and her husband did. On the 25 April 1675, they sold the two apprisings and other related documents to JOHN KING, writer in Edinburgh and his wife for their liferent uses and to their son, WILLIAM KING thereafter. But on the 21 June 1675, JOHN KING sold the documents on to HEUGH ARCHIBALD of Dunbeith and then he, in turn, sold them on the 29 July 1681 to ROBERT Nisbet and his wife, BARBARA Nisbet; hence the charter National Archives of Scotland SIG1/126/29

On the 24 December 1690, James Nisbitt, son and heir of the deceased Robert Nisbitt, second son of the deceased James Nisbitt, elder of Greenholme presented a precept of clare constat by Sir George Campbell of Cesnok, Clerk to the Justiciary and superior of the lands underwritten. In it, Sir George appointed John Hillhous in Hurdstanes, as his baillie to give sasine to James Nisbitt whom he recognised as heir to his deceased father, Robert Nisbitt. His father had owned the 5 merklands of Cesnok, the ten shilling lands of Whirlefoord and the ten shilling lands of Hudstanes, lying in the parish of Riccarton, together with the salmon fishing in the river of Irving and (word unreadable) It was written by John Dalrymple, writer in Galston on the 23 December 1690 and witnessed by Mr Mathew Campbell of Waterhaugh, John Campbell of Killknow, Quintigern Campbell younger of Netherplace and Robert Nisbitt of Greenholme.
